These Terms & Conditions (“Terms”) govern your access to and use of the Studyfound website, platform, applications, and services (collectively, the “Service”), operated by Studyfound (“Studyfound”, “we”, “us”, “our”).
By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
Mandatory rights: Nothing in these Terms excludes or limits consumer protections that cannot be waived under applicable law.
1. Definitions
- “Account” means your registered user account on the Service.
- “Content” means all content available through the Service, including text, data, software, layout, design, databases, and other materials
- “Third-Party Content” means content owned by third parties (including universities), such as program pages, catalogs, PDFs, fees, deadlines, policies, trademarks, and logos.
- “User Content” means anything you upload, submit, or provide through the Service (e.g., CVs, SOPs, transcripts, personal data, messages, saved notes, application tracking info).
- “AI Features” means tools that generate, edit, summarize, recommend, or assist with content using automated or AI systems.
- “AI Output” means any output generated or assisted by AI Features.
- “Subscription” means any paid plan, recurring billing plan, or paid feature.
2. About Studyfound (What We Do / What We Are Not)
Studyfound is an independent platform that may provide:
- University/program discovery tools and organization features;
- Application tracking and deadline management tools;
- AI-assisted document drafting (e.g., SOPs, resumes, emails), summaries, and recommendations;
- Aggregation, indexing, and presentation of publicly available academic information from third-party sources (including universities).
Studyfound is not:
- a university, admissions authority, scholarship authority, or visa/immigration authority;
- an education agent acting on behalf of universities;
- a provider of legal, immigration, or professional advice;
- a guarantor of admissions, scholarships, visas, or outcomes.
All admissions decisions and outcomes are solely determined by universities and other relevant third parties.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into these Terms
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Account Security & Your Responsibilities
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activities under your Account;
- ensuring the accuracy and lawfulness of information you provide.
You must immediately notify us if you suspect unauthorized access or security issues related to your Account.
5. Public Data, Aggregation & Accuracy Disclaimer
The Service may display information obtained from publicly accessible sources, including (without limitation) official university websites, online catalogs/handbooks, bulletins, announcements, and PDFs.
Universities and third parties may change their information at any time without notice. Therefore:
- we do not guarantee the accuracy, completeness, timeliness, or reliability of any information displayed on the Service;
- you must verify critical details (deadlines, fees, eligibility, documents required, policies, scholarship criteria, and program requirements) directly with official sources before acting.
We do not claim ownership over Third-Party Content, university names, trademarks, or logos.
6. No Affiliation or Endorsement
Studyfound is not affiliated with, endorsed by, or partnered with any university or institution unless expressly stated by us in writing. All university trademarks and logos remain the property of their respective owners.
7. AI Features & AI Output
AI Features are provided for assistive and informational purposes only.
You acknowledge and agree:
- AI Output may be wrong AI Output may be inaccurate, incomplete, misleading, outdated, or unsuitable for your use.
- You must review. You are solely responsible for reviewing, editing, fact-checking, and validating any AI Output before use or submission.
- Integrity and originality are your responsibility. AI Output may not be unique and could resemble third-party content. You are responsible for ensuring compliance with academic integrity rules, originality requirements, and any application policies.
- No outcomes are guaranteed. Studyfound is not responsible for admissions results, scholarship decisions, disciplinary outcomes, or reputational impacts arising from use of AI Output.
8. Acceptable Use (Prohibited Conduct)
You agree not to:
- upload forged, fraudulent, or misleading documents or information;
- impersonate any person or entity;
- use the Service for academic dishonesty, misrepresentation, or deception;
- violate any laws, regulations, or third-party rights;
- attempt to access non-public areas, bypass security, or probe vulnerabilities;
- scrape, copy, reverse engineer, or attempt to extract source code, models, prompts, data, or databases from the Service (except as allowed by law);
- disrupt, overload, or interfere with the Service or its infrastructure;
- use automated tools to create accounts or abuse features without our written permission.
We may investigate and take action (including suspension/termination) at our discretion.
9. User Content
9.1 Ownership
You retain ownership of your User Content.
9.2 License to Operate the Service
You grant Studyfound a non-exclusive, worldwide, royalty-free, sublicensable (to service providers), and transferable license to host, store, reproduce, process, display, and use your User Content only to:
- operate, provide, maintain, and improve the Service;
- provide features you request (including AI Features, document tools, and tracking);
- prevent fraud, enforce these Terms, and comply with law.
9.3 Your Warranties
You represent and warrant that:
- you own or have all necessary rights to provide the User Content;
- your User Content does not violate law, third-party rights, or any confidentiality obligations.
9.4 Removal
We may remove or restrict User Content where we believe it violates these Terms, the law, or third-party rights.
10. Intellectual Property (Studyfound)
The Service, including software, UI, design, structure, original databases/compilations, and branding, is owned by Studyfound or its licensors and protected by intellectual property laws.
Subject to your compliance with these Terms, Studyfound grants you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for personal, lawful purposes.
You may not copy, reproduce, distribute, sell, lease, or create derivative works from the Service except as expressly allowed by us in writing or by mandatory law.
11. Feedback
If you submit feedback, suggestions, or ideas, you grant Studyfound a perpetual, worldwide right to use them without restriction or compensation, unless prohibited by law.
12. Payments, Subscriptions, and Billing (If Applicable)
If you purchase paid features or subscriptions:
- the price, billing cycle, and included features will be shown at checkout;
- you authorize us and our payment processors to charge your selected payment method;
- taxes may apply depending on your location and applicable law;
- non-payment or charge failure may result in suspension, downgrade, or loss of access to paid features.
Refunds: Refund eligibility (if any) is governed by our Refund Policy (published on the Service). If no refunds are stated, fees are non-refundable to the maximum extent permitted by law.
Chargebacks/Disputes: Chargebacks or payment disputes may result in immediate suspension pending investigation and may require additional verification before reinstatement.
13. Service Availability, Changes, and Discontinuation
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability.
To the maximum extent permitted by law, we are not liable for any downtime, delays, feature changes, or loss of access.
14. Third-Party Links and Services
The Service may contain links to third-party websites or services (including university sites). We do not control third-party services and are not responsible for their content, policies, accuracy, or availability. Your dealings with third parties are solely between you and the third party.
15. Copyright / Rights Complaints (Takedown)
If you believe content on the Service infringes your rights or should be removed, contact us with:
- the specific URL/content;
- your basis for the request;
- proof of ownership/authority; and
- the action requested (removal/correction).
We may review and take action at our discretion and/or as required by law. We do not promise action within any specific timeframe.
16. Disclaimer of Warranties (“AS IS”)
To the maximum extent permitted by law, the Service, Content, AI Features, and AI Output are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied, or statutory, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability.
17. Limitation of Liability
To the maximum extent permitted by law, Studyfound will not be liable for any:
- indirect, incidental, special, consequential, exemplary, or punitive damages;
- loss of profits, revenue, data, goodwill, opportunities, or reputation;
- admissions rejections, scholarship denials, visa outcomes, or academic/disciplinary consequences;
- reliance on Third-Party Content, aggregated information, or AI Output;
- third-party actions, websites, outages, or policy changes.
Liability cap: To the maximum extent permitted by law, Studyfound’s total cumulative liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Studyfound in the 12 months prior to the event giving rise to the claim, or USD $100, whichever is lower.
Some jurisdictions do not allow certain limitations; in that case, liability is limited to the maximum extent permitted by law.
18. Indemnification
You agree to indemnify, defend, and hold harmless Studyfound, its founders, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
- your use or misuse of the Service;
- your User Content;
- your violation of these Terms or any law;
- your infringement of any rights of any third party.
19. Termination and Suspension
We may suspend or terminate your Account or access to the Service at any time if we believe you:
- violated these Terms;
- used the Service fraudulently or abusively;
- created legal or security risk for us, users, or third parties; or
- are required to be restricted by law or a lawful request.
You may stop using the Service at any time. Termination does not affect rights or obligations that by nature should survive (including IP, disclaimers, limitation of liability, indemnity, and dispute resolution).
20. Privacy
Your use of the Service is subject to our Privacy Policy (published on the Service), which describes how we collect, use, and process personal data. The Privacy Policy is incorporated into these Terms by reference.
21. Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including outages, natural disasters, war, terrorism, labor disputes, epidemics, government actions, internet or hosting failures, and third-party service failures.
22. Dispute Resolution, Arbitration, and Class Action Waiver
22.1 Informal Resolution First
Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.
22.2 Arbitration (Maximum Protection)
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, seated in Dhaka, Bangladesh, conducted in English, under the Bangladesh Arbitration Act, 2001 (or any successor statute) and any applicable arbitration rules selected by the arbitrator consistent with that Act.
22.3 Individual Claims Only (No Class Actions)
To the maximum extent permitted by law, you agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
22.4 Individual Claims Only (No Class Actions)
Nothing prevents either party from seeking injunctive or equitable relief in court to protect intellectual property rights, confidential information, or prevent unauthorized access or misuse.
If arbitration or the class waiver is unenforceable in your jurisdiction, disputes will be resolved in courts as described in Section 23.
23. Governing Law and Venue
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles.
Where court proceedings are permitted under these Terms or applicable law, you agree to the exclusive jurisdiction and venue of the courts located in Dhaka, Bangladesh, unless mandatory law requires otherwise.
24. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on the Service and will become effective on the stated effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
25. General Legal Terms
- Severability: If any provision is held invalid, the remaining provisions remain in full force.
- No Waiver: Failure to enforce any provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms to an affiliate or successor.
- Entire Agreement: These Terms and any policies referenced constitute the entire agreement between you and Studyfound regarding the Service.
- Language: If we provide translations, the English version controls to the extent permitted by law.
- Electronic Communications: You consent to receive communications electronically (email, in-app notices, postings on the Service).
